1. Who provides Devoured

Devoured is provided by Polar Origin AS, organisation number 936 893 864, c/o Burghard Riechel, Svenneviktoppen 23, 4521 Lindesnes, Norway.

In these Terms, "Devoured", "we", "us", and "our" mean Polar Origin AS. "You" means the person who uses Devoured.

2. What these Terms cover

These Terms of Service apply to Devoured, including the Devoured iOS app, devoured.app, support services, subscriptions, features, content, cookies, website flows, analytics, marketing pages, and related services.

By creating an account, using the app, subscribing, accessing devoured.app, joining a waitlist, signing up for updates, or otherwise using Devoured, you agree to these Terms.

For the iOS app, Apple's Standard End User License Agreement also applies to your use of the app as an app downloaded from the App Store. These Terms apply to the Devoured service, account, website, subscriptions, user content, AI features, analytics, marketing pages, and your relationship with Polar Origin AS.

If you do not agree to these Terms, do not use Devoured.

3. Eligibility

Devoured is for users aged 13 and older.

Users under 18 may use Devoured only with the parent or legal guardian consent required by law. Where local law sets a higher minimum age, that higher age applies.

You must complete the age-gate or eligibility flow truthfully.

You may not use Devoured if applicable law, sanctions rules, export-control rules, App Store restrictions, or other platform rules prohibit you from doing so.

4. What Devoured does

Devoured is a private iOS app and website experience designed to help users reduce food-delivery ordering, add friction before ordering, build cooking routines, track progress, estimate savings, use streaks and Pelicoins, manage recipes, review meals, and use educational fasting-timer features.

Devoured may include app-blocking or friction features using Apple Screen Time-related APIs, habit tracking, check-ins, cravings and urge tracking, cooking features, pantry or shopping features, meal photos, AI meal checks, AI recipe assistance, educational content, an optional fasting timer, paywall flows, product analytics, feature flags, experiments, website analytics, and marketing or attribution features.

Devoured is a consumer habit-support app. It is not a medical device, healthcare service, therapy service, dietetic service, nutrition clinic, emergency service, financial service, or food-safety service.

5. Informational content only

Devoured does not provide professional advice. Informational content and app features should not be treated as instructions, recommendations, or a substitute for advice from a qualified professional.

Devoured may include optional general educational content about fasting and a user-controlled fasting timer. Devoured does not recommend fasting, prescribe fasting schedules, provide dietary advice, or tell users to restrict food intake. Use of the fasting timer is optional.

AI meal checks, recipe suggestions, ingredient comments, and similar outputs are informational and may be wrong, incomplete, inconsistent, or unsuitable for you.

You are responsible for your own food choices, allergies, food safety, app use, and whether any information or feature is appropriate for you. Do not rely on Devoured for professional advice.

If you feel unwell, unsafe, distressed, or at risk, stop using the relevant feature and seek appropriate professional or emergency help.

6. Accounts and sign-in

Devoured supports account creation and sign-in through Sign in with Apple.

You are responsible for maintaining control of your Apple ID, device, and Devoured account access. You must not share account access with another person or use another person's account.

You must provide accurate information and keep your account information reasonably current. We may refuse, suspend, or terminate account access if account information is inaccurate, incomplete, fraudulent, unlawful, or creates security, legal, or platform risk.

We may change, remove, or limit sign-in methods, subject to applicable law and platform rules.

7. Subscriptions, trials, billing, and cancellation

Devoured is offered through subscriptions purchased through Apple's in-app purchase infrastructure and the App Store.

Subscription prices, renewal periods, included features, trial availability, trial length, and other purchase terms are shown in the app or App Store purchase flow before you subscribe.

Subscriptions renew automatically unless cancelled through your Apple ID or App Store settings before the renewal deadline shown by Apple.

Apple handles payment processing, billing information, tax handling, subscription cancellation mechanisms, and refund requests. We do not receive your full payment-card details.

We may use Superwall, RevenueCat, or similar subscription, entitlement, receipt-validation, paywall, and analytics providers to present offers, manage paywall flows, validate subscription status, and understand subscription performance.

Deleting the Devoured app or deleting your Devoured account does not automatically cancel your Apple subscription. To stop future charges, cancel the subscription through your Apple ID or App Store settings.

Refunds are handled by Apple and applicable law. We cannot guarantee that Apple will grant a refund.

8. User content and private app data

Devoured lets you create or provide private content and data, such as meal photos, recipes, pantry data, shopping data, notes, onboarding answers, check-ins, cravings, urge events, optional fasting-timer use, AI prompts, AI outputs, app-blocking settings, and app settings. In these Terms, this is "User Content".

You keep ownership of your User Content. You grant Polar Origin AS a limited, worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, transmit, display, analyse, and use your User Content only as needed to provide, operate, secure, support, personalise, maintain, debug, and improve Devoured, comply with law, and enforce these Terms.

Devoured does not include public posting, comments, messaging, public profiles, or social feeds. Your User Content is not intended to be public.

We do not use private meal photos, recipes, pantry data, shopping lists, cravings, urge text, optional fasting-timer settings or status, exact Apple Screen Time app, category, or web-domain selections, private AI prompts, or similar private app content for personalised advertising, retargeting, ad-network sharing, or training models made available to other users or the public, except with your consent.

You must not submit User Content that is illegal, harmful, infringing, misleading, abusive, malicious, unsafe, or that violates another person's rights. Do not submit personal data about another person unless you have the right and permission to do so.

9. AI features

Devoured may use OpenAI to provide AI-powered features, including meal checks, recipe assistance, virtual reward decisions, and related outputs. AI features may process User Content and related app context through OpenAI, as described in our Privacy Policy.

AI outputs can be inaccurate, incomplete, biased, unsafe, inconsistent, or inappropriate for your situation. Review AI outputs before relying on them.

AI features do not replace professional advice. You are responsible for decisions you make based on AI outputs.

You must not use AI features to create, request, or submit illegal, harmful, infringing, abusive, privacy-invasive, or unsafe content.

10. App-blocking and Screen Time features

Devoured may use Apple FamilyControls, ManagedSettings, DeviceActivity, UserNotifications, and related Apple platform APIs to provide app-blocking, schedules, reminders, app-friction features, and behaviour-support features. Exact apps, categories, and web domains you select through Apple Screen Time controls are stored locally on your device; Devoured does not receive or store those exact selections.

These features depend on Apple permissions, device settings, operating-system behaviour, network state, app updates, Apple APIs, and user configuration. They may fail, be bypassed, reset, delayed, or behave differently after iOS updates or device changes.

Devoured does not guarantee that blocking or friction features will prevent ordering, prevent app use, prevent setbacks, save money, or produce any specific behavioural outcome.

11. Pelicoins, virtual rewards, streaks, estimates, and progress features

Pelicoins are virtual in-app points used only inside Devoured. They may be earned through in-app actions such as cooking-related activity, submitting meal photos, completing check-ins, or other actions we make available. Depending on the current feature design, Pelicoins may be used to affect Devoured's app-friction features, such as temporarily reducing or lifting a delivery-app block.

Pelicoins are motivational features only. They are not money, stored value, gift cards, cryptoassets, financial rewards, property, or a financial account. They cannot be bought, sold, transferred, redeemed for money, cashed out, exchanged outside Devoured, or used outside the app.

Pelicoin awards, balances, redemption rules, expiration rules, unlock mechanics, and related app logic may be changed, recalculated, reset, limited, suspended, revoked, or discontinued. Meal-photo or AI-based award decisions may be inaccurate, inconsistent, delayed, or unavailable.

We may refuse, reverse, limit, or remove Pelicoins, streaks, achievements, progress states, or unlocks if we believe there has been abuse, manipulation, technical error, fraud, violation of these Terms, or misuse of Devoured.

Savings estimates are estimates only. They may be based on your inputs, assumptions, and app logic, and may not reflect actual money saved. Devoured does not guarantee that Pelicoins, streaks, savings estimates, achievements, badges, progress states, or app-friction features will prevent ordering, save money, or produce any specific behavioural outcome.

12. Recipes, food safety, and allergies

Recipes, pantry suggestions, shopping suggestions, meal checks, ingredient assessments, and related outputs may be incomplete, inaccurate, unsafe, or unsuitable for you.

You are responsible for checking ingredients, allergens, food safety, storage, preparation, cooking temperatures, nutrition labels, dietary suitability, and whether a meal or recipe is appropriate for your situation.

Do not rely on Devoured to detect allergens, intolerances, medical restrictions, unsafe ingredients, spoiled food, or food-safety issues.

13. Product analytics, experiments, website analytics, and marketing

Devoured may use analytics, diagnostics, feature flags, experiments, paywall analytics, website analytics, cookies, advertising pixels, attribution tools, and marketing technologies as described in the Privacy Policy.

These tools may affect which onboarding flow, paywall, price presentation, feature variant, app-friction rule, website page, or message you see. We may run tests and change variants without separately notifying each user.

Our Privacy Policy explains what data is collected, how it is used, how cookies and similar technologies work, and what sensitive-data limits apply.

14. Acceptable use

You must use Devoured lawfully and responsibly.

You must not reverse engineer, decompile, copy, scrape, crawl, resell, sublicense, or misuse Devoured except where applicable law gives you a non-waivable right to do so.

You must not interfere with Devoured, bypass security, probe systems, overload infrastructure, introduce malware, abuse AI features, manipulate Pelicoins or reward decisions, submit deceptive meal photos, exploit bugs, use automated systems to generate rewards, use Devoured to violate another person's rights, or use Devoured for unlawful purposes.

You must not attempt to access accounts, data, systems, APIs, or infrastructure that you are not authorised to access.

15. Intellectual property

Devoured, including the app, website, design, software, trademarks, trade names, logos, text, graphics, workflows, features, analytics logic, reward logic, and other materials, is owned by Polar Origin AS or its licensors and is protected by intellectual-property laws.

Subject to these Terms and your subscription status, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use Devoured for your own private, non-commercial use.

You do not acquire ownership of Devoured or any Polar Origin AS intellectual property.

If you send feedback, suggestions, or ideas, we may use them without restriction or payment to you.

16. Third-party services

Devoured depends on third-party and platform services including Apple, Supabase, Superwall, RevenueCat, OpenAI, PostHog, hosting providers, email and communications providers, analytics and diagnostics providers, advertising and attribution providers, and other operational providers.

Third-party services may be subject to their own terms, privacy policies, rules, and technical limitations. We are not responsible for third-party services that we do not control.

For purchases through Apple, Apple and its subsidiaries are third-party beneficiaries of the terms applicable to the iOS app licence and may enforce those terms as permitted by Apple's standard terms.

17. Availability and changes

We may change, add, remove, suspend, or discontinue any part of Devoured at any time, including features, paywalls, subscriptions, Pelicoins, streak logic, reward logic, AI features, recipes, app-blocking features, website content, analytics, cookies, marketing features, and support channels.

We do not guarantee that Devoured will be uninterrupted, error-free, available in every country, compatible with every device, compatible with every iOS version, or available forever.

Devoured is available only in countries and regions where we choose to make it available and where use is lawful. We may restrict or stop offering Devoured in any country or region at any time.

18. Privacy and cookies

Our Privacy Policy explains how we collect, use, store, and share personal data, including data processed through analytics, cookies, pixels, marketing technologies, AI features, and third-party providers. By using Devoured, you acknowledge the Privacy Policy.

Where required by law, we ask for consent before using non-essential cookies, pixels, local storage, SDKs, tags, or similar technologies. Cookie and privacy choices may affect website functionality, analytics, advertising measurement, or marketing features.

19. Account deletion and termination

You may delete your Devoured account through the in-app account deletion flow in Settings.

We may suspend or terminate your access to Devoured if you violate these Terms, create risk or legal exposure, misuse the service, manipulate rewards, abuse AI features, cause security or platform risk, or if we are required to do so by law or platform rules.

Account deletion or termination does not automatically cancel an Apple subscription. Subscription cancellation must be handled through your Apple ID or App Store settings.

Sections that by their nature should survive termination will survive, including intellectual property, subscriptions and payment obligations already incurred, User Content licence for retained records, disclaimers, limitations of liability, governing law, and dispute provisions.

20. Disclaimers

To the maximum extent permitted by law, Devoured is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.

We do not warrant that Devoured will meet your expectations, produce specific results, prevent delivery ordering, prevent app use, save money, change behaviour, correctly classify meals, correctly award Pelicoins, be accurate, be uninterrupted, be secure, or be error-free.

Nothing in these Terms limits rights, remedies, or warranties that cannot be limited under applicable consumer law.

21. Limitation of liability

To the maximum extent permitted by law, Polar Origin AS will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, savings, opportunities, expected rewards, Pelicoins, progress states, or behavioural outcomes.

To the maximum extent permitted by law, our total liability for claims relating to Devoured will be limited to the greater of the amount you paid for Devoured in the 12 months before the claim or EUR 100.

Nothing in these Terms excludes or limits liability where exclusion or limitation is not permitted by law, including liability for fraud, intentional misconduct, or mandatory consumer rights.

22. Indemnity

If you use Devoured on behalf of a business or organisation, that business or organisation will indemnify Polar Origin AS against claims, losses, liabilities, damages, costs, and expenses arising from your misuse of Devoured, violation of these Terms, or violation of law or third-party rights.

For consumer users, this section applies only to the extent permitted by applicable law.

23. Export controls and sanctions

You may not use Devoured if you are located in, controlled from, or ordinarily resident in a country or region where use is prohibited by applicable sanctions, export-control rules, App Store restrictions, or other applicable law.

You may not use Devoured for any purpose prohibited by sanctions, export-control laws, or applicable platform rules.

24. Governing law and disputes

These Terms are governed by the laws of Norway, without regard to conflict-of-law rules.

If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply in your country of residence.

Disputes relating to Devoured or these Terms may be brought before the ordinary courts of Norway, subject to any mandatory consumer venue rights that apply to you.

25. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify users, such as updating the app, website, or Terms date, or providing an in-app notice where appropriate.

Your continued use of Devoured after updated Terms become effective means you accept the updated Terms. If you do not accept updated Terms, stop using Devoured and cancel any subscription through your Apple ID or App Store settings.
